Complaints & Sanctions

Judicial review is the process by which the Courts examine the decisions of public bodies and consider whether the law has been correctly followed.

It is important to stress that a judicial review is not a re-run on the merits of the decision as the Courts will confine themselves to considering whether the decision being challenged was lawful and complies with the principles of public law. Through judicial review applications, the courts as well as the external legal counsels have made some comments and recommendations in order for the disciplinary regime as well as the surveillance regime to improve its processes and deliverables. This has been taken seriously by the respected teams in improving its processes to ensure that justice is served accordingly.
